Terms of Service

1. Agreement to Terms

By accessing or using the Skape platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is operated by Skape ("we," "us," or "our").

2. Description of Service

Skape provides a cloud-based ticketing and booking management platform designed for escape room businesses. The Service includes tools for online booking, customer management, operations, marketing, and analytics. We may update, modify, or discontinue features at any time.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information during registration. You must be at least 18 years old to use the Service.

4. Subscription Plans & Billing

Skape offers multiple subscription tiers with varying features and pricing. Free plans are subject to transaction fees on bookings. Paid plans are billed monthly or annually as selected. All fees are non-refundable unless required by law. We may change pricing with 30 days notice.

5. Payment Processing

Payments are processed through Stripe Connect. You must maintain a valid Stripe account to receive booking payments. Skape collects a platform fee (percentage varies by plan) on each transaction. You are responsible for any Stripe fees in addition to our platform fee.

6. Acceptable Use

You agree not to: (a) violate any laws; (b) interfere with or disrupt the Service; (c) attempt to gain unauthorized access; (d) use the Service for any illegal purpose; (e) transmit malware or harmful code; (f) scrape or harvest data from the Service.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for complying with applicable data protection laws regarding your customers' data. We process data as outlined in our Privacy Policy.

8. SMS Messaging Terms

By checking the "Get SMS Reminders" checkbox during the booking checkout process and providing your phone number, you provide your prior express written consent to receive automated transactional text messages from Skape (on behalf of the venue where you are booking) at the phone number you provide. These messages are sent using an automated telephone dialing system and/or prerecorded messages via Twilio, Inc., a third-party cloud communications platform.

Message Types: You may receive the following transactional messages:

  • Booking confirmations
  • Booking reminders (24 hours and 2 hours before your scheduled time)
  • Waitlist availability notifications
  • Group booking invitations
  • Post-experience review requests

Message Frequency: Up to 3 messages per booking (1 confirmation and 2 reminders), plus occasional waitlist, group invite, or review messages. Frequency varies based on your booking activity.

Consent Not Required for Purchase: Consent to receive SMS messages is not a condition of purchasing any service or making any booking. You may complete your booking without opting in to SMS.

Opt-Out: You may opt out at any time by replying STOP to any message. You will receive a one-time confirmation of your opt-out. No further messages will be sent unless you re-subscribe by opting in during a future booking.

Message & Data Rates: Message and data rates may apply depending on your mobile carrier and plan. Skape does not charge for SMS messages, but your carrier may apply standard messaging fees.

Supported Carriers: SMS messaging is supported on most major US carriers including AT&T, T-Mobile, Verizon, US Cellular, and others. Carrier support is not guaranteed and may change without notice.

Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Skape is not responsible for messages that are delayed or fail to be delivered due to carrier issues or circumstances beyond our control.

Third-Party Messaging Provider: SMS messages are transmitted through Twilio, Inc. By opting in, you acknowledge that your phone number and message content will be processed by Twilio in accordance with Twilio's Privacy Policy. We do not authorize Twilio to use your data for any purpose other than delivering messages on our behalf. Your phone number is not shared with any other third parties for marketing or advertising purposes.

9. Intellectual Property

The Service and its content are owned by Skape. You retain ownership of your data and content uploaded to the Service. By using the Service, you grant us a limited license to host, store, and display your content as necessary to provide the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Skape shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.

11. Termination

Either party may terminate the agreement at any time. Upon termination, your right to use the Service ceases. We will make your data available for export for 30 days after termination. We may terminate or suspend accounts that violate these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
